Den rumenske toppfighteren Maius Ilas har blitt dømt for bruk av ulovelige midler under The 4th World Cup som ble avholdt i Russland så sent tilbake som sommer 2009,hvor Ilas endte opp som nr 2. reaksjonene fra miljøet ellers er utelukket posetive. Ikke det at man ønsker dette selvsagt,men når man først tester,deretter tar utøvere som oppererer ulovelig,så er det meget bra at konsekvensen er hva den er. Mange andre steder i idrettsverden ser man at tilsvarende profiler ala Ilas går klar og får ubetydelige straffer fordi de er høyt profilerte. Dette viser WKO sin styrke og seriøsitet når tiltakene kommer til sin rett.

Against the above-mentioned competitor, WKO and the WKO Doping Control Committee have decided as follows, on the basis of the report by the Investigation Committee constituted in accordance with the WKO Doping Hearing Panel provided in the WKO Anti-Doping Code
(hereinafter to be mentioned as "the Code") Article 12.1.2:Text of Decision
1. It is perceived that the above-mentioned competitor used (Doping Rule Violation) a prohibited substance mentioned in the WADA Code.
2. In accordance with Article 14 of "the Code", all of his results obtained in the WKO 4
th Karate World Cup held on June 20th and 21st, 2009, as well as the WKO European Championship held on June 5th, 2010 shall become void, and he shall be deprived of the trophies and prizes obtained at the Competitions.3. In accordance with Article 15.2 of "the Code", his qualification shall be suspended for two (2) years from January 1
st, 2011.Reason
1. According to the "Certificate of Analysis" submitted by the Anti-Doping Center of Russia, dated July 2, 2009, after the WKO 4
th Karate World Cup, the sample collected at the doping test of the same Competition from the competitor concerned included "human chorionic gonadotropin (HCG)" with the density of 16mIU/ml, which exceeds 3 times of the WADA’s positive criteria, which stands at 5 mlU/ml. "human chorionic gonadotropin (HCG)" is included in the Prohibited Substances List in "S2. Hormones and Related Substances" in the 2009 Prohibited List International Standard, which corresponds to the "Prohibited Substances" provided in the WADA Code.Attachment B 2
2. Regarding this case, the competitor himself and a person related to the organization (Romanian branch chief) insisted in writing that this is caused by the competitor’s hormone dysfunction (testicular cancer).
Regarding the development of the above mentioned HCG, we had two tests, with the cooperation of the Legal Department of WADA, to find out if it was caused by doping or by endogenous factors as insisted on by the athlete in question and a responsible person in the competition organization (Romanian branch chief).
Test on May 30, 2010 : HCG Concentration was 4.11 mIU/ml Negative
Test on July 24, 2010: HCG Concentration was 21.70 mIU/ml Positive
In addition, the result of the doping test of the competitor at the WKO European Championship (Kiev) on April 4
th 2009 was negative, with an HCG concentration of 0.1 ~ 0.3 mIU/ml3. The WKO Doping Control Committee held a telephone conference with WADA on November 2
nd, 2010 (Japan time: 8am ~ 9am), in which the viewpoint of Mr. Julien Sieveking, Senior Manager of the Legal Affairs Department and Mr. Osquel Barroso, Senior Manager of the Science Department was stated as "The level of testosterone detected at the blood test after June, 2009 is low. It is considered that he used HCG in order to cover-up the testosterone or other substances he used in June of the same year. Consequently, it is perceived that the competitor himself used (Doping Rule Violation) a prohibited substance mentioned in the WADA Code."
4. In response to the above, the WKO Doping Control Committee once again, noticed the competitor of the holding of a hearing in order to give him an opportunity to defend and explain his case. However, the competitor did not attend the scheduled hearing on December 18
th, 2010, and repeated in writing, the same argument he insisted on before.It has yet to be proven that the hormone dysfunction comes from his own physiological or morbid physical condition, which should be proved by the competitor himself. Thus he has showed nothing which would be enough to reverse WADA’s view as mentioned in 3 above.
5. Considering the above conditions and taking into account the fact that this is his first violation, the period of his disqualification shall be for two years, and his disqualification period shall start on January 1
st, 2011, in accordance with Article 15.2 of "the Code".Attachment B 3

The members individually considered and discussed this doping rule violation case, and the Chairman of the Investigation Committee reported the Committee’s opinion regarding the competitor’s penalty as the "Text of Decision", to the WKO Board and to the WKO Doping Control Committee.
